ThursdayArchitecture provides architectural design consultancy, sustainable building advisory, and heritage restoration services within South Africa. All work is carried out in accordance with the South African Council for the Architectural Profession (SACAP) Code of Conduct and relevant building regulations.
You agree to provide accurate and complete information about your property, site conditions, and project requirements. You are responsible for obtaining any necessary planning permissions, heritage approvals, or environmental clearances unless otherwise agreed in writing. Delays caused by incomplete or inaccurate information may affect project timelines and fees.
All drawings, specifications, reports, and digital models produced by ThursdayArchitecture remain our intellectual property until full payment is received. Upon final payment, you receive a non-exclusive license to use the deliverables for the intended project. You may not reproduce, distribute, or modify the documents for other projects without our prior written consent.
Fees are outlined in your service agreement or proposal. Invoices are due within 30 days of issue. Late payments may incur a 1.5% monthly charge on the outstanding balance. We reserve the right to suspend work if an account is more than 60 days overdue. All quoted fees exclude VAT and disbursements unless stated otherwise.
Our total liability for any claim arising from our services is limited to the total fees paid for the specific project giving rise to the claim. We are not liable for indirect, consequential, or incidental damages, including loss of use, lost profits, or damage to property caused by third-party contractors. This limitation does not apply in cases of gross negligence or wilful misconduct.
Either party may terminate the service agreement with 14 days written notice. Upon termination, you must pay for all work completed up to the effective date, including non-refundable disbursements. We will hand over all deliverables produced up to that point upon receipt of final payment.
We may update these terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes take effect constitutes acceptance of the new terms. If you do not agree, you may terminate your agreement within 30 days of the change.
These terms are governed by the laws of the Republic of South Africa. Any disputes shall first be referred to mediation in Cape Town before arbitration or litigation. The parties agree to attempt resolution in good faith before pursuing legal action.
